This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use Fun 3D and tells You about Your privacy rights and how the law protects You.
We use Your data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
For the purposes of this Privacy Policy:
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Under GDPR (General Data Protection Regulation), You can be referred to as the Data Subject or as the User as you are the individual using the Service.
Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to the developer of Fun 3D.
For the purpose of the GDPR, the Company is the Data Controller.
Application or Fun 3D means the software program provided by the Company, downloaded by You on any electronic device, that converts photos and videos into naked-eye (side-by-side) 3D content.
Service refers to the Application.
Device means any device that can access the Service such as a phone, a digital tablet or other mobile device.
Personal Data is any information that relates to an identified or identifiable individual.
For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.
For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
User Content means the photos, videos and other media You select from Your Device to be processed into 3D content using the Service.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a session or how a feature is used).
Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.
Data Controller, for the purposes of the GDPR, refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information.
Consumer, for the purpose of the CCPA, means a natural person who is a California resident.
Sale, for the purpose of the CCPA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a Consumer's Personal information to another business or a third party for monetary or other valuable consideration.
Fun 3D works on the photos and videos that You choose to import. When You select an item, the Service reads the image or video frames and runs depth estimation on Your Device in order to composite a 3D (side-by-side) version.
Your photos and videos, and the 3D results generated from them, are processed and stored locally on Your Device. We do not upload Your photos, videos or generated 3D content to the Company's servers, and We do not use them for any purpose other than producing the 3D effect You requested.
You may delete any generated record at any time from within the Application, which removes the associated local files from Your Device.
Fun 3D offers an optional, PIN-protected Private Space where You can keep selected 3D records separate from Your main library. The PIN and the records You mark as private are stored only on Your Device. We have no access to Your PIN and cannot recover it on Your behalf; please keep it safe.
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), device model, operating system version, the features of the Service that You use, the time and date of Your use, the time spent on those features, unique device identifiers and other diagnostic data.
When You access the Service through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, unique device identifiers and other diagnostic data. This information is used to keep the Service stable, diagnose problems and improve performance.
If You submit feedback through the Application, We collect the description You write and, if You choose to provide it, the contact detail You enter so We can reply. Providing contact information is optional.
To support the Service, We display advertising. Our advertising partners may collect and process Your device advertising identifier and similar diagnostic information to deliver and measure ads. See the "Advertising" section below for details and opt-out options.
The Application requests only the permissions it needs to function, and only at the time the related feature is used:
Fun 3D does not request access to Your contacts, microphone, phone, location or camera. You can enable or disable any granted permission at any time through Your Device settings.

Your photos, videos, generated 3D records and Private Space data remain on Your Device until You delete them or uninstall the Application. The Company does not retain copies of this content.
We will retain Usage Data and feedback only for as long as is necessary for the purposes set out in this Privacy Policy, including for internal analysis, to strengthen security, to improve functionality, or to comply with Our legal obligations.
Information processed by Our Service Providers, such as advertising and diagnostic data, may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where data protection laws may differ from those in Your jurisdiction. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.
Under certain circumstances, the Company may be required to disclose Your data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

The security of Your data is important to Us. Because Your photos, videos and 3D content stay on Your Device, the primary safeguard for that content is Your Device's own security. For the limited data processed by Our Service Providers, We strive to use commercially acceptable means of protection, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure, and We cannot guarantee its absolute security.
Service Providers have access only to the limited data needed to perform their tasks on Our behalf and are obligated not to disclose or use it for any other purpose.
We use third-party advertising services to display advertisements that help support and maintain the Service. Advertising in Fun 3D is delivered through the TopOn (AnyThink) mediation platform, which may serve ads from networks such as Google AdMob. These partners may use Your device advertising identifier and similar information to deliver and measure ads, including personalized ads.

We do not sell Your photos, videos, generated 3D content or feedback. However, the advertising Service Providers We partner with may use technology on the Service that "sells" advertising identifiers as defined by the CCPA. You can opt out of the use of Your information for interest-based advertising by using the "Opt out of Ads Personalization" (Android) or "Limit Ad Tracking" (iOS) controls on Your Device, and by following the Google opt-out instructions referenced in the "Advertising" section above.
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information.
Our Service may contain links to other websites that are not operated by Us, including those reached through advertisements. If You click a third-party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy in the Application and updating the "Last updated" date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes are effective when they are posted.
